{"id":950,"date":"2019-12-17T10:08:22","date_gmt":"2019-12-17T08:08:22","guid":{"rendered":"https:\/\/www.ministryofjustice.gr\/English\/?page_id=950"},"modified":"2019-12-17T10:08:46","modified_gmt":"2019-12-17T08:08:46","slug":"the-maastricht-and-amsterdam-treaties-2","status":"publish","type":"page","link":"https:\/\/ministryofjustice.gr\/English\/?page_id=950","title":{"rendered":"The Maastricht and Amsterdam Treaties"},"content":{"rendered":"<p style=\"text-align: justify;\" align=\"left\"><b>EUROPEAN CONFERENCES<\/b><\/p>\n<ul style=\"text-align: justify;\">\n<li><a href=\".\/?page_id=945\">'THE ROLE OF EUROJUST AND ITS DIRECT COOPERATION WITH THE EUROPEAN JUDICIAL NETWORKING AS WELL AS THE COMPETENT NATIONAL AUTHORITIES FOR A COMBINED FIGHT AGAINST CRIMINALITY'<\/a><\/li>\n<\/ul>\n<p style=\"text-align: justify;\"><b>The Maastricht and Amsterdam Treaties<\/b><\/p>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"text-align: justify;\">The sector of Justice and Home Affairs (JHA) of the European Union (EU) establishes the cooperation between the 27 Member-States in the field of justice and internal security.<\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"text-align: justify;\"><b><u><a href=\".\/wp-content\/uploads\/2019\/12\/synthiki_tou_maastricht_en.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">The Maastrict Treaty or the Treaty on European Union (TEU)<\/a><\/u><\/b><b>,<\/b>\u00a0which came into force on the 1<sup>st<\/sup>\u00a0of November 1993, refers to the establishment of an\u00a0<strong>area of freedom, security and justice<\/strong>. This treaty led to the creation which commonly referred to as the\u00a0<a href=\"http:\/\/en.wikipedia.org\/wiki\/Three_pillars_of_the_European_Union\" target=\"_blank\" rel=\"noopener noreferrer\">pillar structure of the European Union<\/a>. The issues of justice and internal security were included in the third pillar of the EU under the VI title of the TEU and promote the police cooperation, customs authorities cooperation, immigration services and judicial authorities cooperation of the Member -States.<\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"text-align: justify;\">The creation of a common area of freedom, security and justice has been asserted as an aim of the European Union in the\u00a0<b><u>Amsterdam Treaty<\/u><\/b>\u00a0\u00a0which came into force on the 1<sup>st<\/sup>\u00a0of May 1999. As regards judicial cooperation, the aim is to ensure that cross-border crimes are dealt with efficiency and that individuals have their rights guaranteed equally, no matter under which Member State's jurisdiction their case is being heard in, whether they are suspects, accused or victims.<\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"text-align: justify;\">The Amsterdam Treaty provides for\u00a0<strong>new legal instruments which are legally binding for Member-States<\/strong>which may have to transpose them, but do not need ratification. The changes in the legal framework have substantially helped to improve the efficiency of the European Union action in this field.<\/div>\n<div style=\"text-align: justify;\">In October 1999, the European Council held a special meeting in Tampere (Finland) which for the first time, was exclusively devoted to issues of justice and home affairs. There, Member- States reaffirmed their commitment to place the development of the Union as an area of freedom, security and justice at the very top of the political agenda.<\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"text-align: justify;\">The European Council of Tampere asserted that\u00a0<u>mutual recognition<\/u>\u00a0should become the cornerstone of judicial cooperation both in civil and in criminal matters. The functioning of the European judicial area could be undermined by differences between national criminal legislation.
